This is equivalent to "if we cannot ascertain the absence of ill intent, we ought to assume ill intent". That's not how it works (or, at least, not how it is supposed to work) in the courts of this country.
No, not really. I don't say every kind of stupidity is like that, but some people in some positions have no business being stupid. Especially if we are talking not of individual persons, but of organizations tolerating stupidity in their midst.
